WARRANTY POLICY

Capacity Trucks is committed to providing you with quality after-market parts.  Many of the parts we sell come with a manufacturer’s warranty.  In that case, that warranty is your warranty and this warranty does not apply but we will work with the manufacturer to obtain coverage on your behalf.  Where applicable, this limited warranty extends to the original purchaser, not to any subsequent purchaser.

Capacity warrants that the part(s), under normal use and service, will be free from defects in material and workmanship. This limited warranty is separate and distinct from the factory warranty that applies to your commercial vehicle.  This warranty does not extend or modify the factory warranty.

The limited warranty period is for one (1) year from the date of shipment by Capacity.   Capacity warrants that during this warranty period, it will replace, repair, or refund, at our sole option, any new part that fails due to a defect in materials or workmanship under normal use and service after proper installation. The sole remedy for any breach of warranty claim against Capacity is limited to the money actually received by Capacity for the part.  As noted above, some parts may be covered by a third-party warranty, rather than this warranty.

To obtain warranty service, contact Capacity customer support department.  You must provide a copy of the original invoice with your warranty claim.  Additional information may be required, as may the return of the part. If return of the affected part is required, you must have a Return Merchandise Authorization number (RMA#) supplied by Capacity prior to returning. Transportation charges on product submitted for repair or replacement under this warranty must be borne by the purchaser.

WARRANTY LIMITATIONS

·          This warranty does not cover parts that fail due to abuse, misuse, alteration, modification, neglect, improper maintenance, impact, accident, collision, normal wear and tear, chemical fallout, environmental conditions, natural disasters or use contrary to manufacturer instructions.

·          This warranty does not cover used or salvage parts, or parts under manufacturer’s recall.

·          This limited warranty does not cover labor, which is your sole responsibility.

·          THIS WARRANTY REPRESENTS THE TOTAL LIABILITY OF CAPACITY, FOR ANY PART. CAPACITY MAKES NO OTHER WARRANTY WHATSOEVER, INCLUDING ANY (A) WARRANTY OF MERCHANTABILITY; (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; OR (C) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE. CAPACITY DOES NOT COVER INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES SUCH AS, BUT NOT LIMITED TO, PHYSICAL INJURIES OR PROPERTY DAMAGE, LOSS OF TIME, LOSS OF USE OF THE VEHICLE, COMMERCIAL LOSS, INCONVENIENCE, RENTAL VEHICLE CHARGES, TOWING CHARGES OR ACCOMMODATIONS RESULTING FROM A DEFECT IN OR FAILURE OF THE PART.

Some states or countries do not allow the exclusion or limitation of consequential or incidental damages or limitations on how long an implied warranty lasts; therefore, the limitations and exclusions above may not apply to you. This warranty gives you specific legal rights, and you may also have other rights under applicable law.
